copyright 「版權」

關於 copyright 如何翻譯的問題，翻譯在此作一說明：

copyright 在英文中指的是「 the right to copy 」，也就是「被
允許進行複製」的權利。目前討論中的使用「著作權」的意見，觀念
應該是來自於「著作財產權」和「著作人格權」的定義。

但是自由軟體運動的認知和現行的國際法律並不相同：

1. 「版權」（也就是「著作財產權」以及「製版權」）並不是「作
者權」（也就是「著作人格權」）原來的附屬而後分離。就自由
軟體運動來說，現行的法律是將兩種毫不相干的觀念融合起來成
為一種體系。
2. 「版權」自始自終就是屬於公眾，只是由於過去「複製」技術的
限制，公眾不可能自行進行複製行為。因此將此「公眾自己無法
進行」的權利，給與創作者以〔版權的〕「特許」，使創作者得
以經由「版權所帶來的法律強制」獲取更多利潤，最終使得公眾
得以獲得利益。
3. 因此，創作者之所以「被特許擁有」版權，其前提是「公眾自己
無法進行複製」以及「最終使得公眾得以獲得利益」。
4. 在以往，這種〔公眾與創作者之間的〕「交易」作用地很好，因
為版權的存在使得這兩種前提都有效地成立。
5. 但是目前由於複製科技的發達，使得「公眾自己無法進行複製」
的前提不再成立，「版權」的繼續「特許給創作者」已經無法
「最終使得公眾獲得利益」。
6. 因此，將「版權」「重新回復為公眾所有」才是應有的作為。這
也是為什麼有 copyleft 觀念的主要原因：一個創作者擁有「作
者權」，但他並不擁有「版權」。「版權」是公眾所有的，因此
創作者聲明自己擁有版權，事實上是對公眾利益的侵犯。

因此，您〔作為一個創作者〕可以禁止他人對您的作品進行修改，因
為那是作者權的一部份；但是卻不可以禁止他人複製您的作品，因為
那是屬於「公眾」的權利。

GNU General Public License

參考中文譯名為「 GNU 一般公眾許可證」。主要的原因是在英文本
的陳述中，General Public 確實是「一般公眾」的意思。如在本
『許可證』中所出現的：

... is available to the general public.

另外在 GNU 哲學頁面中也可以見到類似的陳述，其用法也相同於民
有民治民享的基本概念：

The GNU GPL is designed of the general public, by the
general public, and for the general public.

因為這兩個英文字（ general 和 public ）分別都有許多意義，彼
此之間的差異相當微妙，因此以其用法來看似乎比較合理。

不過在正式參考 GPL 時，還是應該以英文來加以陳述：這支程式是
以 GNU General Public License 加以發表，或這支程式是在 GNU
General Public License 下發表。

如果一定要用中文，按照慣例於文章中第一次出現的地方加以聲明：

... GNU General Public License（參考中文譯名為 GNU 一般公眾
許可證，以下所稱的「一般公眾許可證」指的皆是 GNU General
Public License）

本『許可證』和「GNU 較少一般公眾許可證」也建議是如此用法。

所採用的其它有關中譯術語...

(1) 英文的 copy 一字於譯文中分化為三種用法：

「拷貝」作名詞用（一份拷貝）；
「複製」作動詞用（複製一份文件）；
「副本」則是指正式的文件（本『許可證』的一份副本）。

(2) 英文的 text 一字於譯文中分化為二種用法：

「文字」作為字元／字符及其集合，其實體並不一定具有意義。
「文本」作為具有實際含義的文字及其集合。為文字的子集合。

(3) 其它採用的電腦或普通用語列表：

access 「存取〔權〕」
equivalent 「同等物」
format 「格式」
電腦檔案通常必須按照某一種或數種特定的標準，以作為安排其中所
含的資訊，應該如何以位元（ digit ）來加以表現的依據。我們將
此類的標準稱為格式。
generic 「一般」
用來形容程式時，表示該程式就「達成編輯某一種特定格式的電腦檔
案」而言，至少具有最基本的功能。
location 「位址」
markup 「標記」
於文字格式檔案中設定一些特殊字元以達成「文本化」的作為中，這
些所採用的特殊字元及其所形成的結構稱之。
public-standard 「公開標準」
specification 「規格說明書」
substance and tone 「聲色」
色，表示「物質」之意；故譯聲色。

(4) 如前所述，譯文的唯一目的在於幫助中文使用者能夠更好地理解 GNU
FDL ，因此繁簡用語僅就最常見的進行處理，所採用的差異列表如下：

community 「社群／社團」
derivative 「衍生／派生」
document(ation) 「文件／文檔」
泛指任何形式的以文字為主的作品，任何格式的電腦檔案、雜誌和書
籍等印刷品……等皆稱之。
information 「資訊／信息」
network 「網路／網絡」
program 「程式／程序」
project 「計畫／工程」
software 「軟體／軟件」

3. 您可以告訴它：本『許可證』並不禁止商業行為，同時它也可以選
擇不支付自由文件的工作人員任何版稅。但是我們熱切地希望如果
它能夠經由出版自由文件而獲取利潤時，給予這群默默進行的成員
以適當的報酬。

希望有人能夠幫助建立這份列表。同時如果有已經出版的自由文件，
（或未出版的自由文件）也請知情的您通知翻譯有關的訊息。除了願意
發行自由文件的出版者列表外，也希望可以同時建立「目前已有的自由

我們強調「自由」的目的就在於改進社會的熱忱。希望經由個人的參與和貢
獻，能夠建立起一個更為公平正義的社會。因此，深入地探討相關的議題是
唯一的途徑。只有確實地瞭解了我們想要的社會是個怎樣的社會之後，我們
才能夠接著著手來建立它。

因此這裡有一些可能必須要加以論理的議題，提供給公眾作為參考。

(1) 自由文件的意義〔不限於 GFDL〕？
(2) GFDL 的各項設置如何達到文件自由的目的？
(3) GFDL 改版為 1.2 版所欲因應的新的問題或關切的事為何？

(4) GFDL 就達到文件自由的目的而言，是否已經公設化了？〔即，只採取
最必要的設置，其它的部份自可引申得出。〕
(5) 如果 GFDL 並沒有公設化，那麼公設為何？
(6) 對於各級學校的教科書，最應該採用什麼形式的許可證？〔得出的結論
很有可能不是私權化的許可證，資源是有限的，為何要強迫我們的社會
於此進行不必要的浪費？同時，此一強迫行為與私權軟體目前的作為似
乎並無不同。〕
(7) 出版沒有版權保護的經典書籍和出版自由書籍有何不同？〔結論很可能
是相同的。沒有版權保護，紅樓夢還是有它的市場，同樣一本紅樓夢，
出版者的用心程度決定了它的銷售情形。〕
(8) 書籍作者創作的目的為何？〔結論很可能不是為了由於版權所帶來的經
濟收益，此項收益是經由限制他人複製它的法律強制而來的。同時也沒
有證據顯示自由文件無法獲得經濟收益。〕
(9) 誰能創作自由文件？〔短期之內與私權文件相比，自由文件作者只能取
得很少的資源。但只要持之以恆，經由文件的累積與改進，我們將能夠
在各個領域至少提供一二冊的自由文件，而這對於防止社會資源浪費就
已經可以發揮出重要影響了。各項計畫中的文件撰寫成果也可以直接公
開為自由文件，需要注意的是絕對不要禁止其商業活動。如果在技術上
可以更有效地幫助知識的傳播，那麼就不要以人為的手段來禁止它。〕

翻譯希望這些討論甚至本身也可以作為自由文件加以出版，同時為了仔細地
記錄您所發表的意見，請您務必寄送到某一個郵寄清單中〔以作為正式紀
錄〕，並將郵件副本（c.c.）送到 作為
參考。

請在進行討論的郵件中儘量清楚明白地陳述您的意見，不要含有其它不相關
的討論、意見或問題，回覆的郵件也根據您所回覆的意見調整 Title 行的

0. PREAMBLE

The purpose of this License is to make a manual, textbook, or other
functional and useful document "free" in the sense of freedom: to
assure everyone the effective freedom to copy and redistribute it,
with or without modifying it, either commercially or noncommercially.
Secondarily, this License preserves for the author and publisher a way
to get credit for their work, while not being considered responsible
for modifications made by others.

1. APPLICABILITY AND DEFINITIONS

This License applies to any manual or other work, in any medium, that
contains a notice placed by the copyright holder saying it can be
distributed under the terms of this License. Such a notice grants a
world-wide, royalty-free license, unlimited in duration, to use that
work under the conditions stated herein. The "Document", below,
refers to any such manual or work. Any member of the public is a
licensee, and is addressed as "you". You accept the license if you
copy, modify or distribute the work in a way requiring permission
under copyright law.

mathematics.) The relationship could be a matter of historical

The "Invariant Sections" are certain Secondary Sections whose titles
are designated, as being those of Invariant Sections, in the notice
that says that the Document is released under this License. If a
section does not fit the above definition of Secondary then it is not

Invariant Sections. If the Document does not identify any Invariant
Sections then there are none.

The "Cover Texts" are certain short passages of text that are listed,
as Front-Cover Texts or Back-Cover Texts, in the notice that says that
